I’ve not been able to take any leave yet this year because of the extra work we have had, can I carry it over?

Last updated: 11 May 2020

The new Working Time (Coronavirus Amendment) Regulations provide for carry over of leave ‘where it is not reasonably practicable for a worker to take some, or all, of the holiday to which they are entitled due to the coronavirus’.

This will only apply to the four weeks annual leave due under the Working Time Directive, and not necessarily additional contractual leave.

Usually there is no statutory right to carry forward unused leave at the end of the holiday year, but the new regulations provide that this can be done for the next two leave years.
