Prospect statement on EHRC guidance on single-sex spaces

Prospect is committed to campaigning for working environments that are free from discrimination, harassment or victimisation based on an individual’s gender identity. 

It is crucial that transgender and non-binary workers and their needs are respected and valued. This must include ensuring that transgender workers have the basic dignity of not having to reveal their gender identity whenever they use a bathroom or changing facility. 

The delay and uncertainty surrounding the publication of this guidance has caused significant distress to transgender and non-binary workers. It has also made it impossible for the union to work effectively with employers to ensure measures are in place to properly support our members. 

We will study this lengthy guidance closely and seek legal advice if necessary to fully understand the implications, as we are committed to providing all possible support to our members. 

We urge employers to take the time to consult with employees and unions to ensure that all appropriate steps are taken to support those affected.
